These Terms of Service (“Terms”) govern your use of forsalespokane.com and any related services (collectively, the “Site”), operated by Joey Costello, a licensed real estate broker with Windermere North Spokane (“we,” “our,” or “us”). By accessing or using the Site you agree to these Terms. If you do not agree, please do not use the Site.
Listing data on this Site is provided by the Spokane Association of Realtors (sarmls) under an Internet Data Exchange (IDX) license from MLS Grid. The information is deemed reliable but is not guaranteed accurate by the MLS, the listing broker, or us. All measurements, square footage, lot size, school assignments, taxes, and HOA dues are approximate and should be independently verified by the buyer prior to making any decision. Active listings may sell, change price, or be withdrawn at any time without notice. Some listings shown may be off-market, sold, or pending; the Site labels these where possible but discrepancies are inevitable.
Listing photographs and descriptions are the property of the listing broker or agent and are displayed under the IDX agreement. If you are a listing broker and wish to opt a listing out of display on the Site, please contact us using the information below and we will remove it promptly.
Content on the Site — including market reports, neighborhood guides, AI-generated home visualizations (“Dreams”), and the Spokane Permit Explorer — is provided for informational purposes only. It does not constitute legal, tax, appraisal, or financial advice. Always consult a qualified professional before making real estate, lending, or investment decisions.
The Site offers AI-powered tools that re-imagine a listing photo according to a text prompt (“Dreams”) and AI-narrated cinematic video tours (“Cinema”). These outputs are generated automatically and may contain inaccuracies, hallucinations, or features that do not exist in the actual property. AI-generated images and videos are illustrative only and are not representations of the property's real condition. Do not rely on AI output to make purchase decisions. By submitting a prompt or photo to the Dream feature, you represent that you have the right to do so and grant us a non-exclusive license to process and display the resulting visualization.
When you submit a contact form, request a tour, request a CMA, or send a private tour invitation, the information you provide (name, email, phone, address, message) is forwarded to Joey Costello and stored in our database for the purpose of responding to your inquiry. Submissions may also be sent to a partner agent if you are inquiring about a listing represented by another broker. We will not sell your contact information to data brokers or use it for purposes unrelated to real estate services. See our Privacy Policy.

Original content on the Site — including text, layouts, software, branding, cinematic video templates, and aggregated market data — is the property of Joey Costello / forsalespokane.com and is protected by U.S. and international copyright, trademark, and trade-secret law. MLS listing data and photographs remain the property of their respective owners and are used under our IDX license. You may view, save, and print pages for personal home-shopping use, but any commercial reuse requires written permission.
If you believe content on the Site infringes your copyright, please send a written notice to joey@forsalespokane.com including: (a) a description of the copyrighted work; (b) the URL of the allegedly infringing content; (c) your contact information; (d) a statement made in good faith that the use is not authorized; (e) a statement under penalty of perjury that you are the rights holder or authorized to act on their behalf; and (f) your physical or electronic signature. We will respond promptly in accordance with the Digital Millennium Copyright Act.
The Site relies on third parties for hosting, analytics, payments, AI inference, video and email delivery, mailer printing, and related services. We are not responsible for the content, availability, or practices of these third parties — their respective terms and privacy policies apply when you interact with them. This includes (but is not limited to): Google / YouTube, Vercel, Linode/Akamai, Replicate, Anthropic, OpenAI, Resend, Lob, Stripe, MLS Grid, and the Spokane Association of Realtors.
THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or harmful components.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL JOEY COSTELLO, WINDERMERE NORTH SPOKANE, OR THEIR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE — INCLUDING RELIANCE ON LISTING DATA, AI-GENERATED CONTENT, OR MARKET REPORTS. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
You agree to defend, indemnify, and hold harmless Joey Costello, Windermere North Spokane, and our affiliates from any claim, liability, or expense (including attorney's fees) arising out of your use of the Site, your submissions, or your violation of these Terms.

These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-law provisions. Any dispute arising from or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in Spokane County, Washington, and you consent to the personal jurisdiction of those courts.
We may revise these Terms from time to time. The updated version will be indicated by a new “Last Updated” date above. Continued use of the Site after a change constitutes acceptance of the revised Terms.
